This is captain manish kumar. I had booked a flat in chartwell 1, flat no. 202 on 28th of january 2008. The builders were hiranandani palace gardens private limited & the project name was “hiranandani palace gardens, chennai”. The scheduled date of delivery was mid 2012 at the time of booking. Later the company declared themselves bankrupt & the property was auctioned by lenders hdfc & was purchased by another arm of hiranandani, evita constructions.
They have already taken more than 90% of the flat value from me in phased manner from 28th of january 2008 to 14th of december 2012. The new developers say that they have just bought the assets from hdfc bank during auction & bank has not handed over any liability to them in the contract. They are saying that they will be obliging us by handing over the property & they are not responsible for any delay. It’s almost 5 years now & more than 52 lakh rupees of mine is stuck with them. They are not willing to pay any interest for the delay as well. A big fraud is going on right under the nose of state & central government & everyone is keeping eyes closed & feigning ignorance.
Kindly take action in this regard.
