I bought Skoda Rapid from Asset Auto, Pune in november 2012, financed by Volkswagen Finance India Private Limited (VWFPL) as that was quickest option available, VWPL folks were working in same premises of Asset Auto. I had taken loan of 800000 for 5 years tenure. I had been paying installments regularly until december 2016, Lately I had gone through financial crises, lost job. So I couldn’t pay two installments (01/2017 & 02/2017), in the month of March VWFPL represntative came & seized Vehicle for non payment of two installments, as I was unaware of RBI guidelines that atleast three installments are required to be defaulted for repossession, I didn’t do anything, car had been confiscated by VWFPL when less than year tenure was remaining.

I got job back at the end of February, two weeks prior seize, so I requested them that immediately I couldn’t pay, but in couple of month I would pay remaining outstanding amount which was less than 200000. VWFPL didn’t respond. Within month time after seize car had been sold out, without giving me opportunity to repay & get back car. I had been continuously calling VWFPL guys, writing email to repay balance. But VWFPL didn’t listen. Couple months after auction VWFPL represntative told me about auction, that too after follow-up, sold way below market price. After months of follow up with VWFPL, finally agreed to return car verbally over phone. When I asked same over email, they didn’t respond & later said can’t return car, it’s sold out & transferred refund, which was below market price, which I continued rejected as I want my car back, VWFPL hadn’t followed procedure in seize as well as in Auction. So finally I have decided to file complaint against VWFPL & showroom in consumer court.
