Subject matter: request for compensation for damage caused by your very late delivery of the My unit 401 Azizi Rivera 16 Meydan One Al merkad Dubai – United Arab Emirates.
My name is Samar ALKadri, bearing Emirates ID no 784-1962-3280636-2. I’m the owner of unit 401 AZIZI Riviera project, block no 16 ( Riviera 16 – 401 ) I bought this unit on ( 30 Oct 2017 ) as I was told that the handover is on ( quarter 4 – 2018 ). Since then and till now, more than 6 years, nothing happened!
As you know the property unit mentioned was purchased as it is from the first phase of the residential complex that was supposed to be delivered first quarter of 2018, especially since the purpose of buying this property is for housing and not for investment and I bear the price difference in the transfer of ownership of the apartment mentioned above about 20,000 dirhams, which resulted in material damage, where I had to pay a six-year housing rent, estimated of more than AED 400,000 where I had to renew the tenancy contract every year. Although I have lost my job recently.
I have committed with you all payments (100%) and all settlements have been done directly by me as scheduled without any delay and based on the previous, and not being able to reach a solution with you despite meeting with your employees more than hundred times.
On 7th October 2020 after many correspondences with you one of your team, Mrs Nadia Umair, has sent me an e-mail with the following alternative solutions:

We write with regards to your recently raised request for cancellation and refund for your property in Azizi Riviera.
Your request has been thoroughly reviewed and escalated along with the best recommendations from the Customer service team. Unfortunately, the cancellation/ refund is not possible for your unit as the construction in this project is fully active and being carried forward with the best capacity.
“We duly understand your frustration and will be happy to offer alternative solutions as mentioned below that would maintain and increase the value of your investment with AZIZI Developments.
· We would offer the savings on remaining completion amount of approximately AED 46,000/- equivalent to expected rentals for almost 19 months.
· If you would like us to provide you with possible option of unit swap to other properties which is near to completion.

However, straight after this e-mail I tried to contact her, but unfortunately, she was kicked out from AZIZI!! And these solutions were ignored and neglected!!
You are urgently requested to compensate me with the equivalent of the bank interest rate on the amounts paid to you for the period of six years. Or find a compensation solution as soon as possible.
Please respond within five days from the date of this e-mail, and if you don’t reply I’ll transfer the case to the Dubai Land Properties and to the court taking into consideration that I have offered the subject to an attorney, and he is ready to start the case.
