E-BAY – damaged product

I PURCHASED A MOBILE ON E-BAY 02-03-2015
BUT THE MOBILE TOUCH IS NOT WORKING FROM 1ST DAY
I CONTACTED TO SERVICE CENTER AND THEY SAID WE DID NOT SERVICE E-BAY PRODUCTS.
I CONTACTED TO E-BAY THEY GIVEN SELLER NUMBER BUT IT WAS NOT WORKING AGAIN I CONTACTED TO E-BAY CLAIM AND I RAISED A E-BAY CLAIM.
AFTER TWO DAYS THEY MAILED TO ME PLEASE TAKE DOA COPY FROM SERVICE CENTER AFTER THAT PLEASE FORWARD THAT DOA COPY TO US.
AGAIN I CONTACTED TO SERVICE CENTER THEY SAID WE DID NOT GIVE ANY DOA LETTER AND WHAT THEY SAID IS THE E-BAY PEOPLE AND SELLER IS FRAUDING YOU.

AND IN E-BAY GUARANTEE POLICY ALSO THEY MENTIONED IF ANY DAMAGED ITEM RECEIVED WE JUST REFUND OR REPLACE THE ITEM.

IN THAT GUARANTEE POLICY THEY DID NOT MENTIONED IF THE DAMAGED ITEM IS ARRIVES WE WANT DOA LETTER ETC….

IT IS CLEAR THEY ARE TRYING TO ESCAPE AND CHEATING THE CUSTOMERS

PLEASE HELP ME IN THIS ISSUE

However, in this case the item received is completely as per description but not as per your expectation. So, eBay would not be able to intervene in this anymore as the claim falls under non-eligible criteria.

    As per eBay policies products with Manufacturer warranty are excluded from eBay Guarantee* coverage as you can visit nearest Authorized service center of the Brand and get the issue resolved. So we would request you to visit the nearest service center and get the issue resolved.
