Inordinate delay in giving possession of the above property by the builder as per section 2 (1) (G) of consumer protection act 1986

And unfair trade practice as per section 2 (1) (R) of cpa 1986.

We had bought the above property on 15/3/2012 and the agreement is registered on 29/07/15 signed on 15/06/15 as per the agreement we were suppose to be given the possession of flat by 31/12/16 with extension clause of six months which means we should have been given the flat by 30/06/2017.
We have received provisional occupancy certificate (Oc) on 15/5/19 with 16 conditions to be complied by the builder as on date the builder has not confirmed about complying of all the conditions.

We have paid 97% of the installments as on 14/03/2017.

We are not paying the balance as the agreement is one sided and the flat is being given without individual electric meter and individual water connection for the flat. Even after inquiring we are just told everything is complied.
Though no proofs/reply of our latest few e/mails have been given to us.

We had filed with rera on 30/11/2017 and rera is pro builders they have just passed an order stating flat will be ready by 31/07/18 and if not than interest will be given by the builders which was given to us from aug 2018 to may 2019. Even though the oc is provisional oc rera is accepting as final oc and asking us to take the possession of the flat.

We are aggrieved by the rera order and since they are pro builders where they state that all home buyers should be given flats and if the builder pays to some home buyers refund how they will complete the project which is unsatisfactory answer.
Rera should take responsibility whether oc is part or final oc and whether the agreement has been complied and is the flat in a habitable state?

We are asking for refund with interest and compensation as on 31/08/19 indian rupees 93, 57, 566.00 till the date of realization of cheque @18% as the builder charges 24% as per the agreement.

Hand over possession of flat till 2022 dec ,all sanitary fittings painting bathroom, module kitchen Work is pending,I’m visiting every month and convince them but they not come front and give us any ensure promise Laxmi, Prachi vikas, Savio these are the culprits of ekta with owner

    Finally I’m given cheating and fraud against complaint to bandra police station and lodging rera complaint
