I took A2303, Hiranandani Club Meadows, Bangalore – 560068, on rent in May 2018. Owner Name: Dibyendy Roy. I stayed in this property for 2.5 years. The latest monthly rent I pay was 28,350 per month and security deposit we gave was 1,62,000.
I gave notice to vacate the property on 16th November and mentioned that last day would be 20th December. Since I agreed to repaint the house and carry on all repair work, I vacated the property on 10th December and started all maintenance work. This gave the owner 10 complete days for any inspection and point out any specific repair work to be done. On 15th all work was completed and on 16th owner sent the Hiranandani persons for inspection. They took all photos etc. and sent to Mr. Dibyendu. He didn’t tell me anything at that point of time and everything was ok. On final day of 18th Dec. he started pointed out things like Wardrobe loose screws / seepage work (this seepage work was brought to owner’s attention multiple times while I was staying in property).. but he is insisting that I pay seepage repair charges too, which is just not acceptable. I told him to deduct around 5k to tighten wardrobes screws etc. which is reasonable, but he is insisting to deduct 20,000 more. Even though these are minor wear and tear that happens over time in every property. This is beyond the repainting and deep cleaning I already did for him.
This is pure monopoly and he is trying to deduct as much money as he can since he has my money with him and he thinks he can do anything.
Here is my breakup:
Deposit with him: 1,62,000
Extra money with him (quarterly maintenance). Extra for 10days: 1700
Legal deductions:
Rent for November: 28,350
Rent for December, till 20th : 18,900
Minor repair work that he pointed in end even though inspection was done earlier: 5,000
Refund he should deposit: 1,11,450
In my whole stay in this apartment for 2.5 years, I never defaulted on rent. I always paid rent on 1st day of month. I did carry out all routine maintenance works etc. and this behavior in end to hold as much money as possible is completely unethical.
