apartment name:- SJR The Pavilion, flat no 501, fuji block, address;- the pavilion, devarabisanahalli, Bangalore 560103, this complaint is regarding the deposit being held for an unnecessary reason and stating that the apartment was used for subleasing for other people, however, on the contrary, they have taken 5 to 6 months deposit of INR 200,000(two lakh) and the rent charged was INR 36000.00 this was on higher side in the area when I took the apartment. we have vacated the apartment on the 16th of August 2019 and until now there was no response from the Nest away,
Just to quote, i have taken one more flat in the same premises of SJR the pavilion, where am staying 201Everest, had this been case they won’t have allowed me,
Even during a chat with the owner, he has accused me of subleasing but I have cleared him saying that it was friends who used to visit us as they worked nearby company called Quest. They would visit us whenever they have work in this area. Hence he told me to vacate the house as he feels i have subleased and to his convenience, I said ok and shot an email to property managing agent called Nest Away, and thereafter I have been emailing them.
After letting them know through emails on the 27th of Jul 19, i have informed that due to many issues in the apartment i would be vacating on the 1st of Sept 2019 hence if there is any checking to be done agent can come and do the needful and they did the same and i was waiting for the refund. and they cleared me by saying that they would need the key of the apartment, i paid the pending electricity bill and accordingly emailed them the details.
No one responded until today saying that they would not return my deposit due to breach in the contract, basically, they meant to say my INR 200,000.00 ( 2lakh) is taken for no reason, Is there any fear of law or not, they have sent me a fearless email was shocked,
PS:- even the owner while chatting with him he was clear that Nest away property management was a disappointment for him as they take way more time to resolve and response which he termed it as ALMOST USELESS,
