Since around december 2017, omaxe owes to me re 2, 03, 326 as penalty for the delay in handing over of the flat. Omaxe issued a credit note no.[protected] for this amount on 24 march 2018 but has not yet paid the money. I have sent 3 emails to mr. Alok kapoor of omaxe office in mullanpur, punjab but he has not responded. You are requested to help me get the refund.

In cases of delay the Hon’ble Supreme Court has held that the Builder who has delayed the possession, complete in all respects, inclusive of Occupation/Completion Certificate, cannot get away by payment of the minimal amount(s) stipulated in the Allotment i.e. Rs. 5/- per square foot etc. Such like cases are daily filed against Builders including Omaxe, Emaar, Unitech etc. and the Hon’ble Consumer Commissions of Punjab and Chandigarh regularly grant approximately 12% PA on the period of delay along with compensation qua mental harassment and/also litigation costs.
