I am a resident of gurgaon and had booked a 2bhk flat in a project being developed in sec-68 gurgaon by the developer m/s pareena infrastructure pvt ltd c7-a, 2nd floor, omaxe city centre, sector-49, sohna road, gurgaon haryana 122018.
The total price communicated by the developer for the said flat was in the range of ₹55, 00, 000 to ₹60, 00, 000 (All inclusive) which was agreed by me. I paid a booking amount of ₹5, 00, 000 (Rs. Five lakhs) on 30th january 2014 vide cheque number 152829 drawn on icici bank. I was issued a receipt for the money and was told that the papers related to property will be given later.
In the coming month i. E may 2014, the developer further asked me to pay another instalment of ₹707468 (Rs. Seven lakh seven thousand four hundred sixty eight). The same was paid by me on 16th may 2014 vide cheque number 979096 drawn on icici bank for which i was issued a receipt for the same. The price on enquiry during the same time was again communicated the same that is in the range of ₹55, 00, 000 to ₹60, 00, 000 (All inclusive).
For next one year no communication regarding the construction of the flat was communicated.In may 2015 i was asked to send another sum of ₹3, 27, 741 (Three lakh twenty seven thousand seven hundred and forty one). I paid the aforesaid amount of ₹3, 27, 741 (Three lakh twenty seven thousand seven hundred and forty one) on 31st may 2015 vide cheque number 979103 drawn on icici bank on the reassurance that the cost of the flat shall remain between ₹55, 00, 000 to ₹60, 00, 000 (All inclusive).
However in the third week of august 2015 i was sent a builder-buyer agreement to sign, wherein the price of the flat was mentioned as ₹84, 04, 042 (Eighty four lakh four thousand forty two only). Shocked by the abrupt increase of ₹25, 00, 000 without any prior intimation, communication or acceptance from my side and sending of the builder buyer agreement to sign i immediately approached the developer and communicated to them that i was not at all interested in the purchase of the said flat on the enhanced amount and asked them to refund the money already received by them immediately.

Since then i have been asking to the developer constantly that i am not interested in the purchase of this flat on the fraudulently enhanced price and requesting them to refund my amount already paid to him. But i regret to say that nothing has been communicated to me till date in this respect. Their office informed that no money would be refunded so i should go for allotment where again i was forced to take 16th floor irrespective of the fact that i begged them for a lower floor as my mother has health issues.
We have got another demand letter without even starting excavation of our tower and bba has not been signed yet.
Moreover we have learned from the website of haryana department of town and country planning that the no license had been issued to the developer for the construction of flat till 13-08-2014 whereas he had already collected a sum of ₹12, 07, 468 (Rs. Twelve thousand seven thousand four hundred sixty eight only) for the flat for which they had no license to construct. Which itself is indicative of the developer’s intentions.
They have already harassed me very much, inflicting enormous amount of mental agony and financial loss to me and my family. I request you sir to kindly help me to get refund of my hard earned money paid to the developer amounting to ₹15, 35, 209 (Rs. Fifteen lakhs thirty five thousand two hundred nine only) and take strict action against the developer for the fraudulent practices adopted by him.
