This is regarding my booking of a flat in Supertech’s Officer’s Enclave, Gurgaon in January 2016 under Subvention Scheme. I booked it through Investor’s Clinic which has a tie up with Supertech to sell its flats. While booking I submitted all the documents as asked by Investor’s Clinic. This particular project is for serving and retired govt officials. I am a retired govt official and fulfilled the criteria. I paid Rs 100000=00 as the initial booking amount.

In July 2016 Investor’s Clinic asked for my ITRs for 3 years. I submitted the ITRs asap. After scrutiny of ITRs Investor’s Clinic informed me that I do not qualify for Subvention because my income is mainly from bank interests. The Company wanted me to go for CLP. Before booking I had clearly narrated that as I am retired I would prefer Subvention because now I can pay the booking amount and under Subvention after 3 years I will pay the total due amount by selling my current accommodation in Kolkata. Everything was agreed to and I paid the amount to confirm my booking.

Investor’s Clinic informed me that if I do not continue with my booking I will not get any refund of whatever I have paid. I spoke to Supertech and it was the same reply. Since last three months I have been chasing Supertech and Investor’s Clinic to refund my money but both companies are sending me the same replies.

Its a case of fraud and cheating wherein the Investors Clinic did not ask for my ITRs at the time of booking. If the company had asked for it along with all other documents i would have submitted it there and then. They could have checked whether i qualify or not for this booking before asking for payment. Why it was required after 8 whole months?

Now since as per the Company i do not qualify under the Scheme i consider it as ‘Auto Cancellation’ but the Company says ‘they do not refund any money if booking is cancelled’. Fact is I did not cancel it on my own volition. It has got cancelled automatically.

I am submitting this to Consumer Court after trying my best to get back my hard earned money. I am ready to submit documents as and when required.
