I also booked a 3 BHK Flat in Sector 89, Faridabad with Ferrous Infrastructure Pvt. Ltd. and above grievances are all true and without any exaggeration.
I have so far made 92.5% payment and balance 7.5% is payable on possession. Committed possession date was Oct’10 and it is already January, 2015. Ferrous keeps on deferring possession date and now Company is promising possession by March, 2015. Recently Company sent me a letter dated 03.11.14 advising that
“As you are aware, the construction of the Tower, where your unit is situate, was completed long ago, however due to unavoidable force majeure circumstances, we have been unable to hand over the possession of the unit to you.”
And further that
“We have decided that in case you wish to proceed with the fitouts of your unit, then you may take your unit for the purpose of fitouts.”
Since then I have written letters dated 18.11.14 & 16.01.15 sent under Speed Post and also mails dated 25.11.14, 03.12.14, 17.12.14, 23.12.14, 29.12, 14, 05.01.15, 14.01.15 seeking their response on following :-
1. What is meant by ‘Fitouts’ as stated in your above letter.
2. Forced Majeure Circumstances” due to which Ferrous was unable to give possession and resultant period of delay caused by such Circumstances.
3. Whether Club House, Power House, Lift, Parking slots etc. are ready in Ferrous City.
4. Payment of compensation @ Rs.5/- per Sq. ft. w.e.f. Oct’10 till actual possession for the delay in possession as per Builder Buyer Agreement and as confirmed by Ferrous vide its mail dated 23.04.13 that compensation would be paid at the time of possession. Since Flat, as confirmed by Ferrous, is now ready for possession and delayed compensation is more than final installment due, request was made for sending demand notice for final payment after adjusting delayed compensation payable and making payment of the balance amount
Despite above follow-ups and telephonic calls, there is no response from company whatsoever.
It is wastage of time to expect this company to stand upto its commitment and this issue should now be taken up with Consumer Forum as has been done by one of our other friend Mr. Abhishek Vaidya (case numbers 116/2008 and 117/2008 in the Qutub Institutional Consumer Disputes Redressal Forum. – Customer code 2006/SI/36/330 and 2006/SI/36/332.). The court finally found them guilty of misrepresentation and duping us of money and ordered to pay 12% P.A. simple interest to Mr. Vaidya alongwith 1 Lac per party as litigation cost/mental agony.
I appeal to Ferrous management though this Forum to take note of our grievances and take remedial measures immediately failing which we shall be constrained to take matter to Consumer Forum for its logical solution. I urge upon my other friends also who have booked their Flat in Ferrous to get prepared for a legal fight in Consumer Court against Ferrous if the Company refuse to budge.
