Subject: Deficiency in services.so i want my money to be return.
It is with great regret that I am writing this letter to make you conscious of the inconvenience and hardship caused to me due to your deficient services.
I received a call from your Company Executive, told that he has selected my profile from job portal and he can provide me job opportunity with the brand name like Tata steel, Jindal Steel and IBM etc.
Thereafter your executive again called me on next day and told that to avail their services I have to pay an amount of Rs.1798 as one time final payment. Then I replied him that I have been cheated earlier by one agency like you and I told him that later on you will ask for the another payments for providing your another services. The Executive assured that this is one time final payment. On the assurance made by your Executive I made the payment of Rs. 1798. Attached herewith is the copy of payment receipt as Annexure I.
After making the said payment, I did not get the Confirmation message from your Company, and then I talk to your Executive, told him about this regard. Thereafter your executive has transferred call to another Senior Executive told me to visit again on the login account on your web portal and to make the said payment again. He assured me that amount paid excessive will be refunded to me by your company. I was somehow convinced with their assurances and after much insistence by your company executive, I paid the amount via Debit card to your company.
It was clear that the amount of Rs.8100 on different pretexts had been fraudulently grabbed from me by your company’s executives, which was truly appalling and unjustified. Later, we tried asking for the refund of the entire amount a number of times, but never received a satisfactory reply from your company. Attached herewith is the copy of payment receipt as Annexure II.

With a great hope and hearing about a healthy reputation of your Brand name I had availed your services but to my utter disappointment, I have faced the worst.
I am appalled to have received such inept and unprofessional services from your company which has created unnecessary hassles in my life, resulting in loss of time and money.
Your company’s fraudulent actions are liable under Section 2(1)(g) of Consumer Protection Act, 1986 defines “deficiency” as any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by or under any law for the time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service. Also, as per Section 2(1)(r) of Consumer Protection Act, 1986, “unfair trade practice” means a trade practice which, for the purpose of promoting the sale, use or supply of any goods or for the provision of any service, adopts any unfair method or unfair or deceptive practice. Thus, your company comes squarely within the purview of law.
As a consequence of your deficient service and the repeated incompetency displayed by your employees, I have suffered undue hardship and mental frustration.
I would like to emphasize that:
• You have been grossly negligent and unprofessional in your approach.
• I have undergone a lot of extreme stress and mental agony because of your deficient service.
Given the above sequence of events, I request you to refund the entire amount of Rs. 8100/-.
In addition, I request you to compensate me with an amount of Rs. 3,000/- for the extreme stress and mental agony you have caused to me.
In case you fail to act on this letter within 15 days from the date of this letter, I would be forced to:
• Ask my lawyers to file a consumer complaint against you for gross negligence, and deficient service, as well as additional compensation for mental agony and legal costs;
• Ask my lawyers to consider the filing of a civil suit against your organization;
• Start a sustained online campaign spreading the word about the appalling level of service that I have received from you; and
• Issue press releases online and in the print media.
I hope that I do not have to take these steps and look forward to an amicable resolution of this issue.

Warm regards,

Ranjeet Kumar Rai
