I am writing this on behalf of 900+ flat owners who have booked their dream homes in the Project “Hubtown Green Woods” by Hubtown Ltd. (Formerly Ackruti City Ltd.) in Thane west. Most of the flat owners have booked their homes here in year 2008-2009 with a promising date of possession in November 2011. While depending on the floor, all of us have made 80-90% of the payment to the builder Hubtown Ltd. till now.

Despite of regular payments, the work at the site has been slow or for many months, completed halted. Each time we have been getting lame excuses for the delay such as Shortage of labor, shortage of sand, government approvals delay, and now the builder claims that they have no funds to complete the project. So, it is evident that the funds collected from the customers like me are being diverted elsewhere. Ironically, the same developer who claims that they have no funds, has launched a new project in Chembur (Mumbai) with bookings in Full swing. So, they have a new plan to fool new home buyers just the way they did with us 7 Years back.
In these 7 years we have had multiple meetings with the developer & each time we got some date which was later faltered upon by Hubtown Ltd. They have till today faltered upon at least 10 such committed possession dates.

Our project has a varied strata of Home buyers. Some are like me who booked their first home in anticipation to get it in a year’s time & are still paying rent elsewhere. So, we are paying rent as well as EMI for our home loan. There are yet another type of Senior citizens who have invested their hard earned entire life’s savings into the project & are bearing the brunt of rent with their limited pensions. I dont think it is difficult to imagine how these people are surviving.

My humble request to the honorable court is to pass a judgement under Consumer Protection Act, 1986 to ask the developer to compensate the people for the rentals that they are paying since the committed date of posession in 2011 till such time that Hubtown Ltd. gives us the possession of our dream homes. Also, till the time Hubtown completes our project, please stall any further approvals issued to them for constructing any other property in Mumbai. This way we can save more customers from getting fooled by Hubtown
