Excitel – Company Fraud

The company executive called and asked me to pay Rs 750 for fiber device to upgrade the connection. Two months they never responded after taking payment and when they called to remind me that my recharge was expiring, i asked them about my connection upgrade status. The man over phone appeared drunk and after initially denying that i had paid again asked me to pay Rs 750 for same. I again asked him to check, thereafter he promised to upgrade the connection next day. Instead my interne connectivity was limited and i wasnt able to use excitel internet for my last day of plan. The next day when i chatted at custmer care they tld me they dont have any 750 Rs device and they can return it. My question is if a company has no actual device to offer to the customer after a period of two months and to tell customer that they don’t have device and they cant promise the upgrade and i should rather take Rs 750 back if i want, shouldn’t it be considered as fraud by a company hoarding customer money on account of false promises.
