We do not wish to go ahead for the project sky greens and we demanded a refund for the payment that we did which was 205 of the agreement value ( 15lakhs approx plus service tax)
So i requested my refund and i got the below mentioned reply on mail
Dear Faizan,
Firstly I would like to clarify that I had never assured a full refund, but I did say I will try my best to see what I can do for your case.
I have repeatedly informed you and your family to submit the medical documents of your family member who is hospitalised. And as per your assurance, you would give it but you have also failed to do so. So the management and I had no option but to reject the refund. But still I have mentioned that you will receive the refund after deducting your token amount post your flat being sold to someone.
And there is no treachery in it, as we also invest our money forward and if we take refund request from customers, then all customers will ask for refund.
So I hope you understand our decision. We do give you an option to retain your flat if you want so there is no loss of token money.

Dear Gitanjali,
Yes you had told us that you will try to get the complete refund done and on which I told you that we must get compete refund.
Reason being –
1) I was informed by your sales manager at the time of booking that we will get the complete refund without any deductions, if there is any delay in getting your approvals for the project.
The date for the approvals to be received was given as July Mid at the time of booking but after the date passed we had been given a new date over telephonic conversation with CRM that the approval will come in 2weeks again which dint happen after that we were given a date of August end on mail . So here we are just getting new dates from the day of booking till date. Now there is already a delay of 3months.
2) Now if there is a delay in getting the approvals and while still your company does not have the approvals for this project how can you deduct the token amount. Over and above you don’t even have an escrow account for this project,which means my money is being used by your company and your company is getting interest on that amount since the day of booking which was in June , now I just want complete amount paid to you i.e.20% plus service tax.
3) Now about the person who’s hospitalised . PLEASE understand that every citizen has a RIGHT TO PRIVACY , and we want to maintain our privacy as your company is not doing a charity it is our own hard earned money that we are demanding as refund and we don’t want to give any medical or financial document and nobody can force to do so .
4) I would just say that please have a word with Mr.Milind Ruparel or if you can get him connected to give a complete amount refund .

Dear Gitanjali,
You are agreeing that you have invested our money from where your company is getting interest on that amount and there were several others who must have given you an X amount and your company does not even have an escrow account which is mandate as per RERA.
Now please explain me a simple thing that when you don’t have any approvals for your project and while you are still expecting the approvals and it was mentioned by your sales manager Ms.Priyanka Verna and Rupashree that we will get full refund without any deduction if you fail to get the approvals by August end and this was very clear at the time of booking, why your company is denying to refund the full amount which as per law
Now regarding the documents for the person who is hospitalized, let me clear this that every citizen has a RIGHT TO PRIVACY and as per that you cannot force anybody to submit the medical or financial documents.
However to cut short , I have mentioned that it is clear that you don’t have any approvals for this project and we want the compete refund asap.
